By using Radioly's website, following a Radioly station, submitting a track for consideration, or creating a distribution account (together, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.
Radioly operates curated playlists on third-party platforms including Spotify ("Radioly Stations"), and offers digital distribution of audio releases to third-party digital service providers ("DSPs"), including automated ISRC/UPC assignment and royalty tracking ("Radioly Distribution").
You must be at least 18 years old, or the age of majority in your jurisdiction, to create a distribution account, or have a parent or legal guardian agree to these Terms on your behalf. You are responsible for the accuracy of information you submit and for all activity under your account.
You retain all ownership rights to the recordings, compositions, and artwork you distribute or submit through Radioly. You grant Radioly a limited, non-exclusive license to reproduce, store, and deliver that content to DSPs, and, where you submit a track for station consideration, to include it on a Radioly station if selected, solely to provide the Service.
Releases submitted for distribution go through an automated and human review before delivery to stores. Review times vary and are not guaranteed; Radioly recommends submitting at least 3-4 weeks before your intended release date.
You represent that you own or control all necessary rights in the content you distribute or submit, that doing so through Radioly will not infringe any third party's rights, and that your use of the Service complies with all applicable laws.
You may not use the Service to distribute or submit content you do not have the rights to release, submit false or misleading metadata, or attempt to manipulate streaming counts, playlist placements, or royalty reporting through fraudulent or automated means.
You may request removal of any release from any or all connected stores at any time at no cost; removal timing varies by store. Radioly may also remove or decline to distribute a release, or remove a track from a station, at its discretion.
Radioly may suspend or terminate an account for violation of these Terms or fraudulent activity. You may close your account at any time; any royalty balance owed to you will still be paid out.
The Service is provided "as is." Radioly does not guarantee acceptance by any DSP, specific streaming performance, or placement on any Radioly station.
To the maximum extent permitted by law, Radioly's aggregate liability arising from these Terms or the Service will not exceed the greater of one hundred dollars ($100) or the fees you paid to Radioly in the twelve months preceding the claim.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Questions about these Terms can be sent to hello@radioly.net.
